Please read these Terms of Service carefully before using the My Family Safe mobile application and related services.
Acceptance of Terms
By creating an account, signing in, or using My Family Safe, you agree to these Terms and to the Privacy Policy presented in the app. If you do not agree, do not use the service.
Operator Information
These Terms are between you and Coderise Solutions, doing business as My Family Safe. Legal notices and formal correspondence should be sent to: Rua Comendador Torlogo Dauntre, 74, Sala 1207, Campinas, Sao Paulo, Brazil.
Eligibility and Supervision
You may use My Family Safe only if you are legally able to accept these Terms. If you create, manage, or authorize use of the service for a minor or another person under your care, you are responsible for that use and for obtaining any permissions, notices, and consents required by applicable law.
Accounts and Security
You are responsible for keeping your sign-in method, device, and account secure, and for the accuracy of the information you provide. You must notify us promptly if you believe your account has been accessed or used without authorization.
Location Sharing and Connections
My Family Safe is designed to help users share safety-related information with trusted contacts. Do not connect another person, share their location, send wellbeing requests, or trigger safety features for them unless you are authorized to do so and applicable law allows it. You are responsible for how you use information you receive about other people through the service.
Acceptable Use
You may not use My Family Safe to stalk, harass, threaten, surveil without authorization, impersonate another person, interfere with the service, reverse engineer the service except where prohibited by law, submit unlawful content, send false alerts, or use the service in a way that violates law or another person’s rights.
Safety Disclaimer
My Family Safe is a consumer communication and location-sharing service. It is not an emergency dispatch service, security service, insurance product, medical service, or law-enforcement service. Alerts, notifications, wellbeing checks, internet status, and location information may be delayed, unavailable, incomplete, or inaccurate. You should always use your own judgment and contact emergency services or local authorities directly when immediate help is needed.
Third-Party Services
The service may rely on third-party providers for authentication, cloud hosting, messaging, maps, analytics, crash reporting, file storage, and similar functions. Their availability and performance may affect the service, and their own terms and privacy practices may also apply.
Intellectual Property
The service, including its software, branding, text, graphics, and other content made available by us, is owned by My Family Safe or its licensors and is protected by applicable intellectual property laws. Except for the limited right to use the service under these Terms, no rights are granted to you.
Your Content and Feedback
If you upload profile images, support messages, or other content through the service, you represent that you have the right to do so. You grant us a limited, non-exclusive, worldwide license to host, store, reproduce, transmit, and display that content only as needed to operate, secure, support, and improve the service. If you provide feedback, we may use it without restriction or compensation.
Suspension and Termination
We may suspend, restrict, or terminate access to the service if we believe it is reasonably necessary to protect users, comply with law, investigate misuse, prevent harm, or protect the service. You may stop using the service at any time. Some provisions of these Terms survive termination, including provisions about intellectual property, disclaimers, limitations of liability, and indemnity.
Paid Features and Subscriptions
My Family Safe offers paid subscriptions through the Apple App Store and Google Play. Available plans may include individual, duo, and family subscriptions with monthly or yearly billing cycles, with plan details, seat limits, and pricing shown in the store and in the app at the time of purchase. Subscriptions renew automatically unless canceled through your Apple App Store or Google Play account settings before the end of the current billing period. Any free trial, introductory offer, or promotional pricing will be disclosed in the applicable store before purchase and will convert to a paid subscription unless canceled in time under the store’s rules. Refunds, billing disputes, and payment processing are handled by the platform through which you purchased the subscription and are subject to that platform’s policies. We may change subscription offerings or pricing from time to time, and when required we or the applicable platform will provide notice before the change takes effect.
Disclaimers
To the maximum extent permitted by applicable law, the service is provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that the service will be uninterrupted, secure, accurate, or error-free.
Limitation of Liability
To the maximum extent permitted by applicable law, My Family Safe and its affiliates, licensors, service providers, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, revenue, profits, goodwill, or business interruption, arising out of or related to your use of or inability to use the service. To the maximum extent permitted by applicable law, our total liability for claims arising out of or related to the service will not exceed the amount you paid us for the service, if any, during the 12 months before the event giving rise to the claim.
Indemnity
To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless My Family Safe and its affiliates, licensors, service providers, officers, employees, and agents from claims, liabilities, damages, judgments, losses, and expenses arising out of or related to your misuse of the service, your violation of these Terms, or your violation of law or another person’s rights.
Governing Law and Dispute Resolution
These Terms are governed by the laws of Brazil, without regard to conflict-of-law principles. Any dispute, claim, or controversy arising out of or relating to the service or these Terms will be resolved exclusively in the courts located in Campinas, Sao Paulo, Brazil, unless applicable law requires otherwise.
Changes to the Service or Terms
We may update the service and these Terms from time to time. When required, we will provide notice through the app or by other reasonable means. Your continued use of the service after an update becomes effective means you accept the updated Terms.
